Who I am
Fitness & Wellbeing Physiology (ABN 25 547 158 113) is a sole-practitioner exercise physiology and remedial massage clinic run by James Murphy at 40/42 Franklin St, Griffith ACT 2603. This policy explains how I collect, use, store and share your information under the Australian Privacy Principles in the Privacy Act 1988 (Cth) and the ACT Health Records (Privacy and Access) Act 1997. Because I am the only clinician here, "I" in this policy means James Murphy, and I am personally responsible for how your information is handled.
What I collect
I collect the information needed to treat you safely and bill correctly:
- Identity and contact details: name, date of birth, address, phone, email, emergency contact.
- Health information: your health history, medications, diagnoses, referral letters, assessment results, treatment notes and exercise programs.
- Funding details: Medicare, DVA, NDIS, workers compensation or private health details needed to process claims.
- Communication records: emails, phone messages, and forms you submit through this website.
How I collect it
Most information comes directly from you, through the onboarding form, in appointments, or by phone and email. With your consent I may also receive information from your GP, specialists, other treating practitioners, or your funding body. Website enquiry and referral forms are delivered to my practice email; this website also uses Google Analytics to understand how visitors use it. Analytics data is aggregated and does not identify you.
How I use your information
- To assess, treat and monitor you as a client.
- To communicate with your GP, specialists and treating team where your care requires it and you have consented, including the written reports that Medicare and DVA referrals require.
- To process billing through Medicare, DVA, the NDIS, insurers and private health funds.
- To manage appointments, reminders and practice administration.
- To meet my legal, professional and insurance obligations.
AI-assisted clinical notes
I may use an AI scribe within my practice software to help draft clinical notes from session recordings or transcripts. This is optional and only happens if you have ticked the consent box on the onboarding form. You can withdraw that consent at any time by telling me, and your care is exactly the same either way. Recordings are used only to produce your clinical note and are handled within the practice software's security controls.
Who I share it with
I share your information only where your care or your funding requires it:
- Your GP and treating team, with your consent, for referrals, reports and coordinated care.
- Funding bodies and insurers (Medicare, DVA, NDIS, workers compensation, private health funds) to process claims and meet their reporting requirements.
- My practice management software and secure service providers, who store data on my behalf under their own privacy and security obligations.
- Where the law requires it, for example a court order or a serious threat to someone's safety.
I never sell your information, and I do not share it with anyone for their marketing.
Marketing
If you opt in, I may occasionally email you practice news or health information. Every marketing email includes an unsubscribe link, and unsubscribing never affects your care. I do not send marketing texts, and I do not use your health information to target advertising.
Storage and security
Clinical records are held in secure, access-controlled practice management software. Access is limited to me. Paper documents are scanned into your record and securely destroyed or locked away. Health records are retained as the law requires: at least seven years after your last appointment for adults, and for children until age 25.
Access and correction
You may ask to see your health record or request a correction at any time by emailing admin@fwphysiology.com. I will respond within 30 days. There is no charge for reasonable access requests.
Complaints
If you have a concern about how your information has been handled, please tell me first at admin@fwphysiology.com or 0418 153 608 and I will do my best to fix it promptly. If you are not satisfied with my response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992, or to the ACT Health Services Commissioner.
